I. Conditions of sale

These general conditions of sale (“Conditions of Sale”) establish the terms in which we supply the products (“Product” or “Products”) presented on our website www.myclubchair.com (“our site”).
Read these Conditions of Sale carefully before ordering Products from our site. These Conditions of Sale tell you who we are, how we make our Products available to you, how the contract can be terminated on your initiative and ours, what you should do in the event of a problem, and communicate to you other important information. If you do not accept these Conditions of Sale, you must not order a Product from our site.
1. We
1.1 www.myclubchair.com is an website operated by 2AL, registered in the Toulouse Trade and Companies Register under number 512223967. Our head office is located at 2 bis place de l’église – 31600 Saubens – France. Our intra-community VAT number is FR47512223967.
2. Order on the site
2.1 You can order Products directly on our site: www.myclubchair.com 24h / 24h or by phone at +33 (0) 5 62 20 70 01 Monday to Friday from 10:00 to 17:00, we are closed on Saturday, Sunday and holidays
2.2 You acknowledge that by placing an order on our site, you contract the obligation to pay for the Products ordered if we accept your order. The company 2AL reserves the right to cancel or refuse any order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is being administered.
2.2 When you place an order, the procedure allows you to check and correct any errors before finalizing your order. Take the time to read and check your order carefully at each stage of the ordering process.
2.3 All orders are subject to our acceptance. After receiving your order, you will receive a confirmation e-mail which will constitute acceptance by us. The sales contract will not be concluded until this e-mail has been sent. You will receive another email as soon as your order has been shipped.
2.4 Orders must be paid in full before shipping as we do not practice cash on delivery. Once it has been dispatched, an order can no longer be canceled. If you change your mind about an order already shipped, you can refuse delivery or return the Products to us in accordance with the return policy.
2.5 Before ordering Products on our site, it is your responsibility to check that they will easily enter your home as far as the destination room. The dimensions of the access points must be large enough, depending on the product chosen, so that the delivery takes place in good conditions and that no other problem could complicate the delivery, or even make it impossible. These checks are your responsibility and are your sole responsibility. In the event that delivery cannot take place, due to a poor appreciation of the dimensions, the cost of this will be invoiced to you.
2.6 Your contact details must be kept up to date so that we can contact you for your order or delivery of the Products.
3. Availability of products
3.1 All the Products presented on the Myclubchair.com website are made to order (excluding waxes and exhibition models), according to the specifications requested by the Customer.
Orders for Products are subject to the availability of materials.
If, for any reason whatsoever, the delivery of the Products should be delayed due to supply, we will inform you as soon as possible upon receipt of your order.
4. Pictures, product dimensions
4.1 In accordance with article L 111-1 of the consumer code, Myclubchair.com strives to present as best as possible, the technical data sheets of the products, the essential characteristics of the latter of which the customer must be aware. In no case may Myclubchair.com be held liable for any changes or errors concerning the representation of the product.
4.2 The images of the Products presented on our site are given for information only. We cannot guarantee that your computer will display colors accurately or provide a satisfactory color rendering of the Products. The Products delivered to you may be slightly different from those shown in the images.
4.2 Although we do everything in our power to be as precise as possible, the dimensions indicated on our site, including the weights, dimensions and capacities, are only approximate.
5. Product prices
5.1 The price of a Product is that indicated on our site.
5.2 The price of a Product can change at any time, but changing a price will not affect an order already accepted by our Customer Service.
5.3 The price of the Products is indicated in euros inclusive of all taxes (where VAT applies) but excluding delivery costs, which are calculated in the ordering procedure for the Products and indicated in the basket once the delivery address has been entered. 6. Payment
6.1 We accept the payment methods indicated on the Payment page. The Products and the applicable delivery costs must be paid before the Products are delivered.
6.2 The sums paid are not considered as deposits or deposits.
7. Delivery
7.1 On Myclubchair.com we offer several delivery services with the deadlines indicated for each Product. To find out more about the delivery of our Products, see the information on the Delivery page.
7.2 You can follow the status of your order at any time by logging into the “Orders” section of your account.
8. Time limits
8.1 Our delivery times are calculated in working days (except Saturday, Sunday and public holidays) and take into account the time taken to manufacture and deliver the product.
8.2 For an order made up of several products with different delivery times, the delivery time for this order will then be based on the longest delivery time. The company 2AL however reserves the right to split the order into several deliveries, at no additional cost to the customer.
9. Cancellation and return
9.1 In accordance with article L.221-18 of the Consumer Code, the Customer (excluding professional Customers) has a period of 14 days from receipt to return the product that does not suit him.
9.2 Return costs are the responsibility of the Customer, only the price of the product (s) purchased are refunded, with the exception of delivery costs.
9.3 The customer who wishes to make a return can make the request from the contact us form.

9.5 The right of return can only be accepted for a product which is in perfect condition, in its original undamaged packaging and suitable for re-marketing.
9.6 The right of return cannot be exercised for custom-made items:
For production according to the sample confirmed by the customer.
Withdrawal is notably excluded (Article L.121-20.2 3rd paragraph of the Consumer Code) for contracts for the supply of goods that are clearly personalised or made to the consumer’s specifications, this concerns all counter-branded products that need to be manufactured according to the specificities (colours, comfort, suspension, made-to-measure) desired by the Customer and for which execution began immediately, with the Customer’s agreement, before the end of the 14-day period provided for above.
10. Refund
10.1 After appraising the “returned product”, we will proceed to reimbursement using the method of payment chosen by the Customer when placing their order. This refund will be made at no additional cost to the Customer and within a maximum of 14 days.
10.2 The right of return cannot be exercised for items made to measure.
10.3 Withdrawal is notably excluded (article L.121-20.2 3rd paragraph of the Consumer Code) for contracts for the supply of goods that are clearly personalized or made up according to the consumer’s specifications, i.e. all countermark products that require manufacturing according to specifications requested by the Customer (color, comfort, suspension, custom-made) and whose execution started immediately, with the customer’s agreement, before the end of the 14-day period provided previously.
11. Ownership
11.1 Ownership of the Products is transferred to you once we have received all of the sums due for the Products, including delivery costs.
11.2 The Products are the responsibility of the Customer (or a third party other than the transporter and indicated by you) from the moment he takes physical possession of them.
11.3 The products remain the property of the company 2AL until full receipt of the order by it, however from delivery or removal, the risks associated with the goods delivered are transferred to the Customer.
12. Guarantee
12.1 You benefit from the “Legal guarantee of conformity: which is 2 years from the delivery of the goods”.
12.2 The warranty applies in the context of normal use (excluding professional use).
12.3 Damage caused by natural wear or by improper use of the product by the customer does not enter into the contractual scope of the warranty as well as the use in a professional context.
13. Sav
13.1 The customer who wishes to make a service after sale request must do so from the contact us form.
13.2 The handling of your request will be effective within 48 working hours and a response will be brought to you by our service as soon as possible.
14. Intellectual property
14.1 The site and brand www.myclubchair.com and the elements that compose it are protected by the intellectual property code and have been registered with the INPI.
14.2 No reproduction is authorized without express prior authorization, except for strictly private use.
14.3 Any use under other conditions constitutes the offense of counterfeiting provided for and severely punished by the provisions of the intellectual property code.
15. Taxes and Customs
15.1 Any order placed on Myclubchair.com and delivered outside of France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination.
15.2 These customs duties and any taxes related to the delivery of an item are the responsibility of the Customer and are their sole responsibility.
15.3 We are not required to check and inform you of the customs duties and taxes applicable in your country, we advise you to check with the competent authorities of your country.
16. Data protection
16.1 In application with the new European standard on Data Protection (GPRD), 2AL undertakes to pay maximum attention to all the personal data provided by its customers. The data collected on the site is intended exclusively for internal use in order to allow us to process orders and is integrated into the customer file.
16.2 The company 2AL refuses to disclose this data to any company whatsoever.
16.3 Pursuant to Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, everyone has the right to access, rectify and object to personal data concerning them. You have a right to rectify your personal data which can be exercised at any time by sending a letter to the following address: MY CLUB CHAIR – 2AL – 22 avenue de Pradié – 31120 Portet-sur-Garonne – France or by doing request from the form contact us by indicating in the object “Data Protection”.
17. Applicable law
17.1 All the clauses appearing in these general conditions of sale, as well as all the purchase and sale operations which are referred to therein, will be subject to French positive law.
In this case, the competent courts will be the civil courts of the place where the customer lives, or of the head office of the company 2AL and this at the customer’s choice.
17.2 In the case where the customer is a professional carrying out his order within the framework of his professional activity, the attribution of competence in the event of litigation, and in the absence of amicable agreement between the parts, is given to the consular courts of Toulouse, all under the provisions of article 48 of the New Code of Civil Procedure.Force majeure
18.1 Force majeure
18.1 The company 2AL cannot be held responsible for the breach of the contract concluded on occasion, force majeure, or in the event of a total or partial strike by the postal services, carriers, and disasters caused by floods or fires.
18.2 With regard to products purchased to meet professional needs, the company 2AL will not be held liable for any direct or indirect damage as a result of this, business interruption, loss of profit, damage or costs, which could arise.
18.3 The choice and purchase of a product are the sole responsibility of the customer. The total or partial impossibility of using the products in particular due to incompatibility of the material cannot give rise to any compensation, reimbursement or questioning of the responsibility of the company 2AL, except in the case of a hidden defect proven, of non-conformity, of defectiveness or of exercise of the right of return envisaged under article 9.
